Minimum Qualification Standards

Education: Bachelor’s degree relevant to the job

Training: 4 hours of relevant training

Experience: 1 year of relevant work experience

Eligibility: CS Professional/ RA 1080 for positions which require the practice of profession

Patent examination competencies

Job Description:

Generally assigned with the less difficult and less complicated applications

  1. Studies the subject matter of the application;
  2. Determines the final classification, if necessary, on applications assigned to them for registration of utility model or industrial designs of new products, machines, articles of manufacture, composition of matter, process or any improvement of any of the foregoing according to the International Patent Classification System;
  3. Determines whether or not the utility model and industrial design application meets the registrability requirement;
  4. Determines whether or not the utility model application meets the industrial applicability requirement;
  5. Conducts formality examination to determine if the specification and claims are drafted in accord with the IRR;
  6. Prepares formality examination report;
  7. Invites amendments to the application to correct formality defects, i.e. broadness, indefiniteness, incompleteness, etc.;
  8. Considers applicant’s arguments and proposed amendments to the application;
  9. Recommends registration of application meets the requirements of registrability and industrial applicability;
  10. Recommends denial of registration if application is considered by law as non-registrable utility model or industrial design;
  11. Recommends withdrawal of applications when applicants fail to respond to Intellectual Property Rights Specialist actions within the reglementary period;
  12. Conducts prior art search concerning registered utility model or industrial design requested for registrability report;
  13. Prepares registrability report concerning registered utility model or industrial design containing citations of relevant prior art documents with appropriate indications as to their degree of relevance which may serve as an aid in the determination of the validity of the utility model or industrial design claims in respect to newness;
  14. Prepares Intellectual Property Rights Specialist Appeals Brief for appealed cases;
    15. Acts as member of the Committee of Three that hears and decides inter partes cases involving highly technical issues if so appointed;
  15. Records and monitors outgoing and incoming communications relating to assigned applications;
  16. Takes charge of security applications under his jurisdiction;
  17. Performs other duties and responsibilities as may be assigned by the senior officials and management;
  18. Prepares and submits periodic reports as may be required;
  19. Cooperates with and assists other divisions or bureaus of the Office; and
  20. Performs such other functions as may be assigned by the superior.
