Minimum Qualification Standards

Education: Bachelor’s degree relevant to the job

Training: 4 hours of relevant training

Experience: 1 year of relevant work experience

Eligibility: CS Professional/ RA 1080 for positions which require the practice of profession

Patent examination competencies

Job Description:

Generally assigned with the less difficult and less complicated applications

  1. Studies the subject matter of the patent application;
  2. Reviews the preliminary search report and formalities;
  3. Determines the final classification and conduct the final search, if necessary, on applications assigned to them for patent, utility model or inventions of new products, machines, articles of manufacture, composition of matter, process or any improvement of any of the foregoing according to the International Patent Classification System;
  4. Evaluates search report to determine relevant prior art to the subject matter (Sec. 24, RA 8293);
  5. Determines whether or not the applications meets novelty requirement (Sec. 23, same law);
  6. Determines whether or not the application meets the inventive step requirement (Sec. 26, same law);
  7. Determines whether or not the application meets the industrial applicability requirement (Sec. 27, same law);
  8. Conducts formality examination to determine if the specification and claims are drafted in accord with the IRR;
  9. Invites amendments to the application to correct formality defects, i.e. broadness, indefiniteness, incompleteness, etc.;
  10. Prepares examination report;
  11. Considers applicant arguments and proposed amendments to the application;
  12. Recommends patent grants if application meets the requirements of patentability i.e. novelty, inventiveness and industrial applicability;
  13. Recommends denial of patent grant if application is considered by law as non-patentable inventions (Sec. 22, R.A. 8293). These type of inventions include: discoveries, scientific theories and mathematical methods, schemes, rules and methods of performing mental acts, plant varieties or animal breeds or essentially biological processes for the production of plants and animals, anything which is contrary to public order or morality, etc.;
  14. Recommends withdrawal of applications when applicants fail to respond to Intellectual Property Rights Specialist actions within the reglementary period;
  15. Prepares Intellectual Property Rights Specialist Appeals Brief for appealed cases;
  16. Acts as member of the Committee of Three that hears and decides inter partes cases involving highly technical issues if so appointed;
  17. Records and monitors outgoing and incoming communications relating to assigned applications;
  18. Takes charge of security applications under his jurisdiction;
  19. Performs other duties and responsibilities as may be assigned by the senior officials and management;
  20. Prepares and submits periodic reports as may be required;
  21. Cooperates with and assists other divisions or bureaus of the Office; and
  22. Performs such other functions as may be assigned by the superior.
