Qualification Standards

Education: Bachelor’s degree relevant to the job (preferably Engineering or Applied Sciences)

Training: Four (4) hours of relevant training

Experience: Four (4) years of supervisory / management experience

Eligibility: One (1) of relevant experience

    7. Proficient in Microsoft Office

Duties and Responsibilities

Generally assigned to examination division to handle patent applications.

1. Studies the subject matter of the patent application.
2. Conducts formality examination in accordance with the requirements of the IP Code (RA 8293), the Implementing Rules and Regulations, and patent examination guidelines.
3. Evaluates eligibility of subject matter of patent applications (Sec. 22 of RA 8293).
4. Conducts preliminary patent search and classification of patent applications relating to new products, machines, articles of manufacture, composition of matter, process, or any improvement of the foregoing.
5. Evaluates prior art documents relevant to the subject matter (Sec. 24, RA 8293).
6. Evaluates patent applications and submissions for sufficiency of disclosure.
7. Determines whether or not the application meets novelty requirement (Sec. 23, RA 8293).
8. Determines whether or not the application meets the inventive step requirement (Sec. 26, RA 8293).
9. Determines whether or not the application meets the industrial applicability requirement (Sec. 27, RA 8293).
10. Prepares all necessary search and examination reports, notices, recommendations, and correspondences.
11. Considers and evaluates applicant’s arguments and proposed amendments to the application.
12. Recommends patent grants if application meets the requirements of patentability; or rejections if application does not meet the patentability requirements.
13. Recommends withdrawal of applications when applicants fail to respond to office actions/requirements within the reglementary period.
14. Prepares Examiner’s Brief for appealed cases.
15. Acts as member of the Committee of Three that hears and decides inter partes cases involving novelty technical issues if so appointed.
16. Records and monitors outgoing and incoming communications and statuses of assigned patent applications.
17. Takes responsibility of security and inventory of applications under his jurisdiction.
18. Performs other duties and responsibilities as may be assigned by the senior officials and management.
19. Prepares and submits periodic reports as may be required.
20. Cooperates with and assists other divisions or bureaus of the Office as required.
