Duties and Responsibilities
1. Conducts hearings for Inter-Partes Cases (IPC) and Intellectual Property Violation (IPV) cases in accordance with relevant laws, rules, and regulations.
2. Prepares and issues subpoenas, summons, notices, orders, resolutions, and other legal instruments required for the proper administration of cases.
3. Receives, examines, and evaluates evidence submitted by parties involved in IPC and IPV cases, ensuring adherence to legal procedures and evidentiary standards.
4. Drafts and prepares decisions, final orders, resolutions, and other legal outputs for review and signature by the Director of the Bureau of Legal Affairs.
5. Provides technical and legal advice to support the adjudication process, ensuring consistency with applicable Intellectual Property Laws, government regulations, and IPOPHL policies.
6. Collaborates with internal and external stakeholders, including legal counsels, IP offices, and enforcement agencies, to facilitate case management, enforcement, and compliance.
7. Maintains comprehensive records and documentation of cases, proceedings, and decisions in compliance with rules on confidentiality, record-keeping, and knowledge management.
8. Applies analytical and problem-solving skills to address complex legal issues and ensure informed and equitable decisions.
9. Demonstrates leadership competencies by contributing to process improvements, supporting organizational change, and fostering collaborative, high-performing work relationships within the Adjudication Division.
10. Performs other legal and administrative functions as may be assigned to support the effective functioning of the Adjudication Division and the Bureau’s mandate to enforce and protect intellectual property rights.
