The Intellectual Property Alumni Association, Inc. (IPAA) and the Japan Patent Office will hold an intellectual property rights (IPR) seminar entitled “The Use of Patents for National Development” on October 24 to 25 at the Ballroom of Dusit Hotel Nikko in Makati City. Atty. Adrian S. Cristobal, Jr., Intellectual Property Office of the Philippines (IP Philippines) Director General, will deliver the keynote address. Sessions on the first day will tackle two major IPR concerns, namely the state of software protection worldwide and in the Philippines , and patenting technology developed by universities and the public sector. Topics to be scheduled under the first set include “Protection of Computer Software-Related Inventions in Japan,” to be discussed by TANI & ABE Patent Attorneys President Yoshikazu Tani; “The Pros and Cons of Software Protection by Patenting,” by IP Philippines MIS and EDP Bureau Director Cecilio Fernandez; and “Open Source Software: Patentability of Open Source Software and Licensing of Its Use” by University of the Philippines (UP) College of Law legal consultant Atty. Michael Anthony Dizon. Bayan Muna Party List Representative Teodoro Casiño will lead the discussion on House Bill 1716 or the Free Open Source Software (FOSS) Act, while Commission on Information Technology and Communication Commissioner Dr. Emmanuel Lallana will talk about open source software as a tool for development. The second set will feature topics such as “State Universities and Colleges in the Philippines Public Research and Development Institutions,” to be led by UP Office of the Vice-President for Development’s Technology Licensing Officer Prof. Edward Deveza; “IP Policy and the Technology Transfer Process,” also by Prof. Deveza; “Marketing the Technology and Some Case Studies” by Department of Science and Technology’s (DoST) Technology Application and Promotion Institute Director Atty. Josephine Santiago; and the “Use of Patents in Japanese Universities and Government Research Centers” by Saitama University-Cooperative Research Center’s Prof. Kimiho Ohta. On October 25, meanwhile, the forum will be divided into two themes, namely the use of patents in the public health sector and patents of business model or method. Topics included in the first set are “Drug Patents in a Developing Country,” to be discussed by Pulumbarit Law Office Senior Partner Atty. Elizabeth Pulumbarit; “Recent Developments in Patent Jurisprudence and Their Effect on the Pharmaceutical Industry” by United Laboratories, Inc. Vice-President for Business Development Atty. Jose Ma. Ochave; and “The Use of Patents in Research & Development in the Pharmaceutical Industry” by Tokyo Institute of Technology-Department of Management Technology’s Prof. Tomoko Saiki and Castillo Laman Tan Pantaleon & San Jose Law Offices Senior Partner Atty. Notel Laman. Meanwhile, the second set will include the following topics: “Business Method Patents: The International Experience” by Cochingyan & Peralta Law Officer Partner Atty. Anthony Peralta; and “Business Method Patent Protection: A Hindrance to the Advancement of New Ideas or an Instrument to Foster Innovation?” by IP Philippines’ Bureau of Patents Director Epifanio Evasco. “The Use of Patents for National Development” forms part of this year’s celebration of IPR Week, as declared in Presidential Proclamation No. 79 dated 1992. The celebration, which runs from October 22 to 26, carries the theme “Great Idea! Intellectual Property Rights Week Celebrates Creativity”.
