MEMORANDUM CIRCULAR NO. 01 Implementation of Office Order No. 128, Series of 2003, Restructuring the Fee Structure of the Intellectual Property Office of the Philippines

TO : IPO CASHIERS ALL CONCERNED FROM : The Director General DATE : 12 January 2004 RE : Implementation of Office Order No. 128, Series of 2003, Restructuring the Fee Structure of the Intellectual Property Office of the Philippines --------------------------------------------------------------------------------------------------------------------------------- In order to afford applicants, registrants and representatives/ practitioners additional time to familiarize themselves with the new fee structure, implementation of the fees listed under the following sections of the subject Office Order No. 128 shall be deferred to 01 March 2004: Section 2. Invention Patent-Related Fees Section 3. Utility Model and Industrial Design-Related Fees Section 4. Patent-Related Fees for Application Under Republic Act No. 165 Section 5. Trademark-Related Fees Accordingly, until 29 February 2004: (a) Old Fees re-established in Office Order No. 128 shall be assessed at the old rates. EXAMPLE: Ref. Code 207 Conversion from Utility Model to Invention. (b) New fees (those that are not included in the old fee structure) shall necessarily be assessed at the rate in the Office Order No. 128. EXAMPLE: Ref. Code 208 Early Publication : Request for publication before the expiration of 18 months from filing date or priority date (c) Old fees established under the old fee structure but no longer in the Office Order No. 128 shall no longer be assessed. EXAMPLE: Ref. Code 213 Issuance of Certificate of Letters Patent All the other fees prescribes in the subject Office Order No. 128 shall be implemented upon the effectivity of said Office Order on Friday, 16 January 2004. In the event that the payment being tendered exceeds the rate of the fees due, the Cashier shall inform the payor by issuing a statement of account that states the correct fees. If the payor insists on paying the higher amount, the cashier shall accept the same and the excess shall be treated as a donation to IPO.
